1. Scope
These Terms of Use govern your use of the mobile application “word.” (the “App”) between you as the user and the provider named in the Imprint. By downloading, installing or using the App, you accept these Terms.
2. Description of service
word. shows a single word each day, optionally tuned to settings you provide voluntarily (e.g. date of birth / zodiac sign). The App works fully offline and requires no user account. Optional features (widgets, typeface selection, archive) are unlocked through a paid subscription.
3. Subscription, prices and automatic renewal
- The App offers two subscription options: monthly €1.99 and yearly €14.99 (prices include applicable statutory taxes; prices actually displayed may vary by region).
- The subscription renews automatically for the chosen period unless cancelled at least 24 hours before the end of the current period.
- Billing, management and cancellation of the subscription are handled exclusively through your Apple ID account (App Store) or Google account (Google Play). You can cancel at any time in the account/ subscription settings of the respective platform.
- The provider does not receive, store or process any payment data; this is handled solely by Apple or Google.
4. Right of withdrawal and its expiry (digital content)
Consumers generally have a 14-day right of withdrawal. For digital content/services, this right expires once performance has begun before the end of the withdrawal period with your express consent and your acknowledgment that you thereby lose your right of withdrawal. By unlocking the subscription features immediately, you give that consent. Refunds are otherwise governed by Apple’s or Google’s policies.
5. Licence
You receive a simple, non-transferable, revocable right to use the App for personal purposes on devices permitted by Apple/Google. Modifying, decompiling, reproducing or distributing the App beyond what the law permits is not allowed.
6. User obligations
You agree not to use the App in an abusive or unlawful manner and not to circumvent any security mechanisms.
7. Warranty and liability
The App is provided with reasonable care but without warranty of uninterrupted or error-free availability. The provider is liable without limitation for intent and gross negligence, under the Product Liability Act, and for injury to life, body or health. For slight negligence, the provider is liable only for breach of a material contractual obligation and limited to the foreseeable damage typical of the contract. Liability is otherwise excluded.
The word selection (including any references to zodiac signs) is for entertainment only and does not constitute advice.
8. Changes to these Terms
The provider may amend these Terms with effect for the future where required for a valid reason (e.g. changes in the law or feature scope). Material changes will be communicated appropriately.
9. Data protection
For details on data processing, see the Privacy Policy.
10. Governing law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of your country of habitual residence remain unaffected.
11. Additional terms for purchases via the Apple App Store
If you obtain the App through the Apple App Store, the following minimum terms required by Apple additionally apply:
- This agreement is concluded solely between you and the provider, not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; beyond that, Apple has no warranty obligation.
- The provider — not Apple — is responsible for any product or liability claims, consumer-protection or regulatory requirements, and third-party claims of intellectual-property infringement.
- Apple and its subsidiaries are third-party beneficiaries of this agreement and entitled to enforce it against you.
- You represent that you are not located in a country subject to a U.S. embargo or designated as “terrorist supporting”, and that you are not on any U.S. restricted-parties list.
